There I was, thinking that my pimpin' of Pimp My Snack would have nothing to do with law, and yet lo and behold, the site received a C&D letter from Viacom over the weekend, because Viacom allegedly owns the trade mark to 'Pimp My...'

And so now the website is called 'Pimp That Snack'.

All in all, lots of interesting questions raised about how Australian trade mark law would approach this, and just in time for my exam revision, too!

Haven't changed anything, feed or otherwise, I must say - just not been up to much!

I was thinking matters of registerability for word marks - could 'Pimp My...' be registered. Is it a combination of words other traders would want to use? It is distinctive, inherently or otherwise? And so on.

But as you point out, one might query the use of it as a trade mark (can't see how it IS a trade mark).

Conclusion: American trade mark law is silly.

I am always reminded of that bit in The Simpsons when Lionel Hutz considers a world without lawyers and in his mind there is a group of happy people, of all creeds and nations, holding hands and singing under a rainbow...
